25-2044 : Halton-Pope-Council Review of Property Manager License Renewals and Improving the Application Process(Exc Res

25-2044

This resolution addresses the renewal of property manager licenses in Buffalo and proposes improvements to the application process. The City Code requires property managers to be licensed annually, with renewals due by November 30th. The Council notes that a recent application period saw only one new application, potentially leaving many property managers operating without a license, which is a violation of Chapter 265.

To improve transparency and accountability, the Council has passed a resolution with three key directives:

  1. Outreach to Unlicensed Managers: The Department of Permit and Inspection Services is directed to actively contact and bring unlicensed property managers into compliance.
  2. Application Amendment: Corporation Counsel is tasked with approving an ordinance amendment that requires new information on the property manager license application. This amendment, proposed by Councilmember Halton-Pope, will require applicants to list the names and duties of all individuals performing property management tasks under their supervision. This aims to ensure the City is aware of all individuals actively managing properties.
  3. Notification: The City Clerk will send copies of this resolution to the Mayor's Office, Department of Permit and Inspection Services, Buffalo Police Department, and Corporation Counsel.

The proposed ordinance amendment, attached to the resolution, details the new information required, including the names and duties of employees performing property management tasks. The amendment also clarifies that a New York State real estate broker's license is required if the applicant collects rents or negotiates rentals, with specific provisions for associate brokers and salespersons. If an applicant is strictly performing maintenance and not handling rents or negotiations, a broker's license is not required. The amendment will take effect once ratified.

The Planning Board has recommended approval with conditions for a Planned Unit Development (PUD) at 680 Amherst Street / Voelker's Lanes. The project proposes a mixed-use development across two phases, including:

  • Phase 1: A 5-story, 230-unit multi-family building on approximately 1.70 acres.
  • Phase 2: Renovation of an existing building at 141 Marion Street for approximately 15 units and construction of a 4-story, 30-unit loft-style building at 111 Marion Street on approximately 1.40 acres.

In total, the development will comprise 275 residential units and approximately 10,500 SF of commercial space (planned bowling alley and bar) on the ground floor along Elmwood Avenue. A 77-stall parking lot is proposed with access from Amherst Street.

The project requires PUD waivers/modifications, including adjustments to front and corner side yard setbacks. The Planning Board found the PUD consistent with the Comprehensive Plan, supporting neighborhood rebuilding and creating quality living environments. The development is considered compatible with the surrounding area, with a townhouse-style design proposed for the Marion Street facade to blend with existing residential homes.

24-1882 : SEQR Neg Dec - 680 Amherst St

24-1882

This item concerns the SEQR (State Environmental Quality Review) Negative Declaration for the "Voelkers Lanes Apartments" project located at 680 Amherst Street, Buffalo, NY, and surrounding properties. The project involves a minor subdivision and major site plan approval for the redevelopment of 3.102 acres. The plan includes the phased construction of 275 residential units, 10,500 square feet of commercial space (bowling alley/lounge), community/office space, and 166 off-street parking spaces. Phase 1 will construct a five-story mixed-use building with 230 residential units and commercial space. Phase 2 will convert an existing building into 15 apartments and construct a new 4-story building with 30 units. The Lead Agency, the City of Buffalo Planning Board, has determined that this action will not have a significant adverse effect on the quality of the environment, and no further environmental review is required. The project is generally consistent with community plans and zoning, although a Planned Unit Development (PUD) designation is requested to facilitate development. Potential impacts on land, air quality, surface water, transportation, noise, odor, light, flooding, flora/fauna, critical environmental areas, historic/archeological resources, energy, human health, and aesthetics were reviewed and found not to be significant.

24-1771 : T.Haut, Planned Unit Development- 680 Amherst & 666, 668, 670 Amherst; 111, 141, 155 Marion; 1634, 1628, 1624 Elmwood in N-3C, N-3E, N-1S Zones (Nor)(Hrg11/6/24)

24-1771

This item seeks a Planned Unit Development (PUD) rezone for a 3.102-acre site at 680 Amherst St., 111, 141, 155 Marion St., and 1624, 1628, 1634 Elmwood Ave. to allow for a 275-unit mixed-use development called Voelker's Lane Apartments. The project aims to replace vacant and underutilized properties with affordable housing and commercial space, requiring waivers from existing N-3C, N-3E, and N-1S zoning.

Phase 1 involves a 5-story building with 230 affordable housing units (60-80% AMI) and 10,500 sq ft of ground-floor commercial space, including a bowling alley and bar. This phase requires waivers for increased density (230 units vs. 49 units allowed by current zoning), building height (60 ft vs. 44 ft), lot width (305 ft vs. 150 ft max), and reduced ground-floor transparency on Amherst/Marion facades (37% vs. 70% min). Construction for Phase 1 is anticipated to begin in 2026 and last 36 months, pending 4% HCR Deal funding.

Phase 2, planned after Phase 1 completion (around 2028), would add 45 units through the renovation of the historic building at 141 Marion St. (15 units) and a new 4-story loft building at 111 Marion St. (30 units).

The project includes 77 on-site parking spaces for Phase 1, which is fewer than the 94 spaces recommended by the Transportation Demand Management (TDM) analysis. This reduction is justified by site constraints and TDM strategies achieving an 11% reduction in vehicle trips, including streetscape improvements, bicycle parking, a repair station, and transit facility enhancements.

The City Planning Board recommended approval with a condition to include front and corner side yard setbacks in the waivers. However, the Legislation Committee has repeatedly tabled this item and previously returned it without recommendation, indicating ongoing review or unresolved concerns. The item is currently tabled until January 13, 2026.

The resolution argues that the previous May 1 to May 21 window was sufficient for public input, departmental hearings, and budget workshops, and that the extended period did not increase transparency or public engagement. It requests an amendment to the City Charter to revert the Mayor's budget submission date to May 1 and the Council's final vote deadline to May 22. 25-777

This resolution, sponsored by Council Member Joseph Golombek Jr., proposes to make it easier for individuals to run for office in Buffalo by reducing petition signature requirements. The resolution highlights that incumbent elected officials have significant advantages and that current signature requirements, especially for independent candidates, are a major barrier to electoral competition.

  • Reduce the signature requirement for Buffalo Common Council candidates from 500 to 250.
  • Equalize signature requirements for candidates running on a political party line and those running as independents.

The resolution cites the City of New York's 50% reduction in signature requirements as a precedent. The item has been repeatedly tabled in the Legislation Committee since April 2025.

25-526 : Authorization of Buffalo Parking and Mobility Authority and Hotel Tax

25-526

This resolution calls on New York State Governor Kathy Hochul and the State Legislature to authorize the City of Buffalo to create two new revenue-generating mechanisms: the Buffalo Parking and Mobility Authority (BPMA) and a 3% Hotel Occupancy Tax. The BPMA would manage city-owned parking structures to generate revenue for capital improvements and maintenance. The 3% occupancy tax would be levied on travelers staying in hotels and other short-term accommodations, contributing to city services they utilize. This request is part of the city's efforts to address a significant structural deficit and find new revenue sources beyond budget cuts and efficiency measures. The resolution urges adoption to support the administration's advocacy for these resources as part of the SFY 2026 State Budget.

25-202 : Halton-Pope, Nowakowski - Addressing Cannabis Enforcement and Tax Revenue

25-202

This resolution addresses the significant shortfall in projected cannabis tax revenue for the City of Buffalo. New York State's cannabis legalization has faced delays, leading to Buffalo collecting only $95,733 in Fiscal Year 2023-2024 against a budgeted $3 million, a mere 3% of the target. For Fiscal Year 2024-2025, $1.2 million is budgeted despite ongoing market uncertainties.

The resolution encourages the Mayor's Office to review state budget details before setting future cannabis revenue projections. It also directs Corporation Counsel to draft a local law establishing a schedule of fines and penalties for illegal cannabis stores, a measure previously authorized in July 2024 but not yet submitted. This local law is seen as crucial for combating illicit retailers and generating anticipated tax revenue. The City Clerk is instructed to distribute this resolution to the Mayor's office, Corporation Counsel, and the Department of Permits and Inspection Services.

25-205 : Nowakowski - Implement Nurse Navigation Program for the City of Buffalo

25-205

This resolution, sponsored by Council Member Mitchell P. Nowakowski, proposes the implementation of a Nurse Navigation Program for the City of Buffalo, in partnership with American Medical Response (AMR).

The program aims to address concerns over long wait times in the 911 emergency response system, which are attributed to an influx of non-urgent medical calls straining resources. The Nurse Navigation Program will employ trained medical professionals to triage these non-urgent calls, directing patients to appropriate care pathways and thereby reducing pressure on transporting EMS resources.

Key points include:

  • Full Funding: The program is entirely funded by AMR Western New York, with no additional financial burden to the City of Buffalo or its taxpayers.
  • Proven Success: The program has been successfully implemented in 32 other cities across the United States, including Rochester, NY, and Baltimore, MD.
  • Next Steps: The resolution requests the attendance of Corporation Counsel, the Fire Commissioner, and the Medical Director of the Buffalo Fire Department at the Legislation Committee Meeting on February 11, 2025, to discuss the feasibility of implementation.

This initiative aligns with the City of Buffalo's commitment to enhancing public health through innovative solutions without increasing taxpayer burden.

24-2027

It references New York State Bill S7346A, enacted in 2018, which authorizes cities to add these unpaid penalties to the annual tax levy after they have been adjudicated, certified by the Corporation Counsel, unpaid for at least one year, and recorded with the county clerk. 24-2028

It highlights that such structures contribute to fire risks, crime, health hazards, and overall neighborhood decline.

The resolution outlines the legal framework for abandonment proceedings under the Real Property Actions and Proceedings Law (§§ 1970-1974 for residential, §§ 1980-1984 for commercial/industrial properties).

Key Actions Requested:

  • The Commissioner of the Department of Permits and Inspection Services is also requested to attend the same meeting to detail their department's role in identifying, certifying, and initiating proceedings for abandoned properties.
  • The Office of Assessment and Taxation and the Law Department are asked to provide an update on the status of an In Rem property auction, noting the last one was held in 2019, which is crucial for returning abandoned properties to productive use.

24-1481 : Nowakowski: Modernizing Fine Caps to Reflect True Costs on Residents

24-1481

This resolution, sponsored by Council Member Mitchell P. Nowakowski, proposes to modernize the fine caps for ordinance violations in Buffalo to better reflect the true costs incurred by the City and to deter negative behaviors. The current maximum fine of $1,500 was established in 1972, and its value has significantly eroded due to inflation. Adjusted for inflation, $1,500 in 1972 is equivalent to $11,193.88 in June 2024.

The resolution requests that the Corporation Counsel file an ordinance change to increase the maximum fine from $1,500 to $3,000 by October 12, 2024. This change aims to ensure that fines are sufficient to both deter violations and cover the City's expenses in addressing issues like blight, housing problems, property neglect, and public dumping, thereby reducing the burden on taxpayers.

25-1046 : Wyatt- Calling for Immediate Action and Accountability in the City of Buffalo’s Lead Hazard Remediation

25-1046

This resolution, initiated by Council Member Rasheed N.C. Wyatt, calls for immediate action and accountability regarding the City of Buffalo's slow progress on lead hazard remediation.

Background: In 2021, Buffalo received a $2 million Federal Lead Hazard Reduction Grant from HUD to remediate 110 residential units. However, as of June 2025, only 18 units have been completed, with $1.5 million in funds at risk of being returned due to underutilization.

Concerns: This underperformance has led to public outcry and highlights a history of mismanagement of federal funds, posing severe health risks (neurological damage, learning disabilities) to residents, particularly children, and disproportionately affecting communities of color. Erie County's successful administration of similar grants is noted as a contrast.

Resolution Demands:

  • An update on the program during the Finance Committee Meeting on June 10, 2025.
  • A comprehensive report from the Mayor's Office and Buffalo Urban Renewal Agency (BURA) detailing reasons for underutilization, current progress, and a strategic plan.
  • Creation of an independent oversight committee with public health experts, community advocates, and stakeholders.
  • Forwarding the resolution to the Mayor, BURA Director, Erie County Executive, NYS DOH, and HUD to emphasize the urgent need for action.

24-1483 : Nowakowski: Strengthening Lease Compliance through Charter Adherence

24-1483

This resolution, initiated by Council Member Mitchell P. Nowakowski, addresses issues with lease compliance and aims to strengthen adherence to the City Charter. It cites two reports from the Comptroller's Office (December 2023 and June 2024) that highlighted deficiencies in the management and oversight of revenue-generating contracts, particularly by the Department of Public Works (DPW).

The resolution argues that the DPW's resources and staffing are strained by responsibilities not explicitly outlined in the City Charter, such as overseeing leases and their compliance. It references City Charter Section § 6-23, which assigns the Director of Real Estate the duty to maintain records related to city property ownership, leases, and sales. Therefore, the resolution proposes that lease compliance oversight should be transitioned to the Real Estate Department.

Key Actions:

  • Requests the Law Department, Director of Real Estate, Commissioner of DPW, and Commissioner of Administration, Finance, Policy & Urban Affairs to attend a finance committee meeting on September 24, 2024, to discuss transitioning staff responsibilities for lease compliance.
  • Requests the City Clerk to submit a copy of this resolution to the aforementioned departments and officials.

The resolution emphasizes that improper lease management leads to financial losses for taxpayers and aims to correct these issues to protect the city's revenue sources.

24-1176

This resolution, sponsored by Council Member Mitchell P. Nowakowski, advocates for the City of Buffalo's Law Department and City Court to more actively utilize receivership as a tool to address severely neglected and dilapidated housing.

The resolution highlights:

  • Widespread Blight: The prevalence of decrepit housing due to neglectful landlords, out-of-town owners, and LLCs, which hinders the city's quality of housing and neighborhood development.
  • Landlord Exploitation: A pattern of landlords exploiting renters by failing to maintain properties to code, leaving tenants in hazardous conditions (e.g., collapsing ceilings, lead paint, electrical issues).
  • Legal Framework: The Buffalo City Court has jurisdiction to appoint receivers for properties with code violations under New York State Law (Chapter 570, Laws of 1909, Article X, Section 202(f)).
  • Successful Precedent: The city has seen success with receivership, citing the case of 40 Cottage, which was improved under Preservation Buffalo Niagara.
  • Legislative Support: The resolution acknowledges and supports Senator Sean Ryan's S7765 and Assemblymember Jonathan Rivera's A10542 (the "City of Buffalo Historic Preservation Receivership Act"), which provide specific procedures for appointing receivers for neglected or abandoned properties.

Key Actions Requested:

  1. The Law Department to review the resolution and state legislation, and begin implementing receivership.
  2. The Buffalo City Court to consider receivership for severely neglected properties.
  3. Acknowledgement of the work done by non-profit receivers like Preservation Buffalo Niagara.
  4. Support for state legislation S7765 and urging passage of A10542.
  5. Distribution of the resolution to relevant judicial and city departments.

This agenda item, 24-214, seeks a comprehensive progress update on the development of an Inclusionary Zoning Ordinance for affordable housing in Buffalo. The ordinance was initially proposed to address the displacement of lower-income tenants and socio-economic segregation. The resolution emphasizes the need for collaboration between the Corporation Counsel, Affordable Rent and Housing Task Force, Office of Strategic Planning, and the developer community to expedite the finalization and implementation of this legislation. The item has a long history of being tabled in committee, with the last recorded action on December 30, 2025, where it was tabled again with the next meeting scheduled for January 13, 2026.

23-1601 : 1 Buffalo River Place and 11 Bolton Place - Designate the Allied Mills Complex as a local landmark.

23-1601

This item proposes to designate the Allied Mills Complex at 1 Buffalo River Place and 11 Bolton Place as a local landmark. The complex, constructed between 1928-1929 with additions in 1948, was a major feed mill operation in Buffalo, producing "Wayne Feeds" animal feed, and is a prominent visual feature of the Valley neighborhood.

Significance: The complex is historically significant for its role in Buffalo's grain industry and its association with unionized mill workers in 1948. Architecturally, it is an excellent example of 20th-century industrial design by master builder James Stewart & Company and was determined eligible for the State and National Registers of Historic Places in 2021.

Current Status & Controversy: The property, owned by Lumen Power Technologies, is currently vacant and endangered due to a demolition permit filing. The owner is not in favor of landmark designation. The Buffalo Preservation Board formally recommended approval to the Common Council on September 25, 2023, citing five specific criteria met under City Code Section 337-15. However, the Common Council's Legislation Committee has repeatedly tabled this item for over two years, with the latest action being "TABLED" on December 30, 2025, delaying a final decision.
