RECEIVE AND CONSIDER CERTIFICATION OF UNOPPOSED CANDIDATES FOR THE GENERAL ELECTION OF MAY 2, 2026.

This item certifies that Ty Wolosin (City Council Member District 1) and Kyle Mickelsen (City Council Member District 3) are unopposed in the upcoming General Election scheduled for May 2, 2026. As a result, their names will not appear on the ballot, and they are considered elected without a vote.

CONSIDER AN ORDER OF CANCELLATION FOR THE GENERAL ELECTION FOR CITY COUNCIL MEMBER DISTRICTS 1 AND 3.

The City of Boerne is canceling the General Election scheduled for May 2, 2026, for City Council Member Districts 1 and 3. This action is taken in accordance with Section 2.053(a) of the Texas Election Code because the candidates for these districts have been certified as unopposed.

Ty Wolosin has been elected as Council Member for District 1.

Kyle Mickelsen has been elected as Council Member for District 3.

A copy of this cancellation order will be posted at each polling place on Election Day.

CONSIDER RESOLUTION NO. 2026-R09; A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AND MANAGE AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF BOERNE AND KENDALL COUNTY FOR FIRE PROTECTION SERVICES.

This resolution authorizes the City Manager to enter into and manage an Interlocal Agreement between the City of Boerne and Kendall County for fire protection services. The agreement, effective from October 1, 2025, to September 30, 2026, outlines the terms for the City of Boerne to provide these services to a designated area within Kendall County. The agreement specifies that Kendall County will pay the City of Boerne for these services, with the maximum compensation for the primary term set at $891,933. The agreement also details responsibilities for capital expenses, liability, and insurance, with Kendall County agreeing to indemnify the City of Boerne for actions related to fire protection services outside city limits, excluding gross negligence or willful malfeasance. The agreement is subject to annual renewal through mutual agreement and formal resolutions.

CONSIDER RESOLUTION NO. 2026-R10; A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AND MANAGE AN AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION (TXDOT) THROUGH A LOCAL ON-SYSTEM AGREEMENT (LOSA) FOR THE INSTALLATION OF ROAD NAME SIGNAGE ON TRAFFIC SIGNALS ON STATE-MAINTAINED ROADWAYS WITHIN THE CITY LIMITS.

This resolution authorizes the City Manager to enter into a Local On-System Agreement (LOSA) with the Texas Department of Transportation (TxDOT). The agreement allows the city to manage the design and installation of ILSN signs (Intelligent Lighting and Signage Network) on traffic signals located at the intersections of Business 87 (Main Street) at RR474 (Blanco Rd) and Rosewood within Boerne city limits. The city will be responsible for all project costs, estimated in Attachment B, and must begin construction within 6 months of agreement execution and complete it within 6 months of the State's authorization to commence construction. The State will not pay for any project costs managed by the Local Government, but may waive its direct or indirect costs if the improvements offer significant operational benefit to the State, as indicated in Attachment B. The Local Government is responsible for utility adjustments, environmental assessments, and acquiring necessary right-of-way.

CONSIDER RESOLUTION NO. 2026-R11; A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AND MANAGE AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF BOERNE AND CITY OF POST TO ALLOW THE SHARING AND USE OF COMPETITIVELY PROCURED CONTRACTS IN ACCORDANCE WITH CHAPTER 791 OF THE TEXAS GOVERNMENT CODE.

This resolution authorizes the City Manager to enter into an Interlocal Agreement with the City of Post. The agreement, made in accordance with Chapter 791 of the Texas Government Code, allows both cities to share and utilize competitively procured contracts. This collaboration is intended to provide additional purchasing options and achieve cost savings for taxpayers in both the City of Boerne and the City of Post. Each city will be responsible for its own payments directly to vendors, and will manage its own contract compliance and enforcement. The agreement has an initial term of one year and will automatically renew annually unless terminated with 30 days written notice.

CONSIDER RESOLUTION NO. 2026-R12; A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BOERNE, TEXAS, AUTHORIZING THE SUBMISSION OF A CRIMINAL JUSTICE GRANT PROGRAM FISCAL YEAR 2027 APPLICATION TO THE OFFICE OF THE GOVERNOR FOR FUNDING FROM THE RIFLE-RESISTANT BODY ARMOR GRANT PROGRAM (BAGP). The City Council of Boerne, Texas, is considering Resolution No. 2026-R12 to authorize the submission of a grant application for the Rifle-Resistant Body Armor Grant Program (BAGP). This grant, offered by the Office of the Governor for Fiscal Year 2027, aims to fund the acquisition of rifle-resistant body armor for all police officers. The city agrees to provide any required matching funds and assures the return of funds in case of loss or misuse. CONSIDER RESOLUTION NO. 2026-R13; A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BOERNE, TEXAS, AUTHORIZING THE CITY MANAGER TO EXECUTE AN ARCHITECTURAL SERVICES CONTRACT BETWEEN THE CITY OF BOERNE AND HOEFER WELKER, LLC FOR THE BOERNE POLICE DEPARTMENT ANIMAL SHELTER PROJECT FOR AN AMOUNT NOT TO EXCEED $47,500.

This item presents the Boerne Police Department's 2025 Annual Report and the Annual Report on Racial Profiling. The racial profiling report details 8,545 traffic stops conducted by the department. Key data includes the race/ethnicity of individuals stopped, the reasons for stops (predominantly moving and vehicle traffic violations), whether searches were conducted (3.96% of stops), and the outcomes of these stops (mostly written warnings or citations). The report also notes that physical force resulting in bodily injury was used in 4 instances during the reporting period. A single complaint of racial profiling was received, which did not result in disciplinary action.

It details revenues and expenditures across various city funds, including the General Fund, Hotel/Motel Fund, Parks Fund, Cemetery Fund, Library Fund, Dispatch Fund, Economic Development Fund, various Bond Construction Funds, Capital Projects Construction Fund, Debt Service Fund, Capital Recovery Fund, and utility funds (Electric, Water, Wastewater, Stormwater, Gas, Solid Waste).

Key observations from the General Fund include:

  • Revenues: Total revenues were $12,164,067, significantly below the budgeted $34,758,887 (35.00% of budget). Major revenue categories like Taxes, Licenses and Fees, and Other Revenues are substantially under budget.
  • Expenditures: Total expenditures were $8,685,347, also well below the budgeted $34,758,887 (24.99% of budget).
  • Surplus: A surplus of $3,478,721 was realized for the quarter.

Several other funds also show significant variances between budgeted and actual revenues and expenditures, with many operating at a lower percentage of their budget than anticipated for this point in the fiscal year. The investment report details holdings across multiple funds, showing beginning and ending book and market values for various securities.

CONSIDER RESOLUTION NO. 2026-R15; A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BOERNE, TEXAS, FOR THE REIMBURSEMENT OF THE SUGGS CREEK SEWER MAIN EXTENSION TO BUC-EE'S LTD, FOR AN AMOUNT NOT TO EXCEED $600,000.

The City Council is considering Resolution No. 2026-R15, which authorizes the reimbursement of Buc-ee's Ltd. for the construction of the Suggs Creek Sewer Main Extension. The reimbursement amount is not to exceed $600,000.
